Agreement between user and Alt Magic

1. Welcome to Alt Magic

The Alt Magic website (the "Site") and the services it provides (the "Service") comprises various web pages, public API endpoints, and application integrations for third parties. The Site and the Service are operated by Alt Magic. Alt Magic is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the "Terms"). Your use of Alt Magic constitutes your agreement to all such Terms. Please read these terms carefully, and keep a copy of them for your reference.

2. Electronic Communications

Visiting Alt Magic or sending emails to Alt Magic constitutes electronic communications. You consent to receive electronic communications and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically, via email and on the Site, satisfy any legal requirement that such communications be in writing.

3. Your Account

If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. You may not assign or otherwise transfer your account to any other person or entity outside of your organisation without expressed written consent from Alt Magic. You acknowledge that Alt Magic is not responsible for third party access to your account that results from theft or misappropriation of your account. Alt Magic and its associates reserve the right to refuse or cancel service, terminate accounts, or remove or edit content in our sole discretion. Alt Magic does not knowingly collect, either online or offline, personal information from persons under the age of thirteen. If you are under 18, you may use Alt Magic only with permission of a parent or guardian.

4. Cancellation/Refund Policy

You can cancel your subscription at any time. You will be responsible for charges up to your cancellation date. Refund requests must be submitted within 30 days from the date of purchase of the Subscription and your refund will be issued within 14-28 working days.

5. Links to Third Party Sites/Third Party Services

Alt Magic may contain links to other websites ("Linked Sites"). The Linked Sites are not under the control of Alt Magic and Alt Magic is not responsible for the contents of any Linked Site, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site. Alt Magic is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by Alt Magic of the site or any association with its operators. Certain services made available via Alt Magic are delivered by third party sites and organisations. By using any product, service or functionality originating from the Alt Magic domain, you hereby acknowledge and consent that Alt Magic may share such information and data with any third party with whom Alt Magic has a contractual relationship to provide the requested product, service or functionality on behalf of Alt Magic users and customers.

6. No Unlawful or Prohibited Use/Intellectual Property

You are granted a non-exclusive, non-transferable, revocable licence to access and use Alt Magic strictly in accordance with these terms of use. As a condition of your use of the Site, you warrant to Alt Magic that you will not use the Site for any purpose that is unlawful or prohibited by these Terms. You may not use the Site in any manner which could damage, disable, overburden, or impair the Site or interfere with any other party's use and enjoyment of the Site. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Site. All content included as part of the Service, such as text, graphics, logos, images, as well as the compilation thereof, and any software used on the Site, is the property of Alt Magic or its suppliers and protected by copyright and other laws that protect intellectual property and proprietary rights.

7. Usage Restrictions

You may not use the Site to create, support, or work on software that executes securities transactions, makes medical diagnoses, or contains pornography. You may not use our API as part of a real-time and/or on-the-fly system to serve alt text on a per-request basis. Violating this restriction may result in your account being cancelled without a refund.

8. Use of Communication Services

The Site may contain chat areas, forums, and/or other message or communication facilities designed to enable you to communicate with a private group (collectively, "Communication Services"). You agree to use the Communication Services only to post, send and receive messages and material that are proper and related to the particular Communication Service.

9. Use of Artificial Intelligence Services and Data

The Service makes use of various Artificial Intelligence ("AI") models and services. All data produced by such models and services and provided to you is intended for use solely by you at your own discretion. We do not use the output data produced by the Service for training or developing other AI models. We do not sell or share the output data produced by the Service with any third parties. Any input data you send to us (e.g. an image file) for the purpose of receiving back output from an AI model is used by us solely for the purpose of generating output to return back to you. We do not use the input data you send to us for training or developing other AI models. We do not permanently store, sell, or share the input data you send to us when using the Service.

10. Materials Provided to Alt Magic or Posted on Any Alt Magic Web Page

Alt Magic does not claim ownership of the materials you provide to Alt Magic (including feedback and suggestions) or post, upload, input or submit to any Alt Magic Site or our associated services (collectively "Submissions"). No Adult Content. Use of adult content, including images, videos, or other media depicting pornography, child pornography, bestiality, hate crimes, violent crimes, war crimes, or similar depictions, is strictly prohibited and is a violation of these Terms and Conditions.

11. Third Party Accounts

You will be able to connect your Alt Magic account to third party accounts. By connecting your Alt Magic account to your third party account, you acknowledge and agree that you are consenting to the continuous release of information about you to others (in accordance with your privacy settings on those third party sites). If you do not want information about you to be shared in this manner, do not use this feature.

12. International Users

The Service is controlled, operated and administered by Alt Magic from India. If you access the Service from a location outside India, you are responsible for compliance with all local laws. You agree that you will not use the Alt Magic Content accessed through Alt Magic in any country or in any manner prohibited by any applicable laws, restrictions or regulations. The Service uses Heroku for website hosting, information technology and infrastructure services.

13. Indemnification

You agree to indemnify, defend and hold harmless Alt Magic, its employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable Advocate's fees) relating to or arising out of your use of or inability to use the Site or services, any user postings made by you, your violation of any terms of this Agreement or your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations.

14. Liability Disclaimer

THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE SITE MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION HEREIN. Alt Magic AND/OR ITS SUPPLIERS MAY MAKE IMPROVEMENTS AND/OR CHANGES IN THE SITE AT ANY TIME. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALL SUCH INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS ARE PROVIDED "AS IS" WITHOUT WARRANTY OR CONDITION OF ANY KIND.

15. Termination/Access Restriction

Alt Magic reserves the right, in its sole discretion, to terminate your access to the Site and the related services or any portion thereof at any time, without notice. To the maximum extent permitted by law, this agreement is governed by the laws of India and you hereby consent to the exclusive jurisdiction of Delhi in all disputes arising out of or relating to the use of the Site.

16. Changes to Terms

Alt Magic reserves the right, in its sole discretion, to change the Terms under which Alt Magic is offered. The most current version of the Terms will supersede all previous versions. Alt Magic encourages you to periodically review the Terms to stay informed of our updates.
